Mahesh Kumatal is an Indian politician and member of the Bharatiya Janata Party (BJP) who was elected as the MLA from Athan during the 2019 Karnataka Legislative Assembly by-election. In 2018, he was elected to the Karnataka Legislative Assembly from Athan as a member of the Indian National Congress (INC).

Career
In 2013, he contested the Athan Assembly seat on an INC ticket, but he lost the election to BJP candidate Laxman Sangappa Savadi. In 2018, he contested and won the Athan Assembly seat as an INC candidate, defeating BJP candidate Laxman Sawad by 2,331 votes. After the Karnataka Legislative Assembly Elections 2018, JD(S)’s HD Kumaraswamy was sworn in as the Chief Minister with the support of INC, BSP, KPJP and independent MLAs. By July 2019, 13 MLAs from the INC and 3 MLAs from the JD(S) had resigned from the assembly, reducing the government to a minority. Besides, 1 KPJP and 1 independent MLA also withdrew support from the government and extended support to BJP. The rebel MPs left Bangalore and camped at a resort in Mumbai. After that, Chief Minister HD Kumaraswamy moved a vote of confidence in the house, leading to the fall of his government. Mahesh Kumatal was one of the 15 MLAs who brought down the Kumaraswamy government by backing the trust vote and shifting allegiance to the BJP.

In July 2019, Karnataka Assembly Speaker KR Ramesh Kumar disqualified independent MLA R Shankar and two Congress-JD(S) MLAs Ramesh Jarkiholi and Mahesh Kumatal. The Speaker announced that the MLAs were disqualified as members of the 15th State Legislative Assembly under Article 2(1)(a) of the Tenth Schedule to the Constitution and 191(a) of the Constitution of India. They ceased to be members of the Assembly before the expiry of the term, which was 23 May 2023. They were also prohibited from participating in mid-term elections. Subsequently, Kumarathali and Ramesh Kumar moved the Supreme Court against their expulsion from the Assembly under the anti-defection law, claiming that the Speaker’s decision was taken in “hot haste” at the behest of the Congress party. In November 2019, the SC upheld the disqualification of 17 rebel Karnataka MLAs, but overturned the Speaker’s decision to bar them from contesting elections until 2023. In December 2019, Kumatali contested and won the Athan Assembly seat as a BJP candidate during the by-elections. In 2023, he contested the Athan Assembly on a BJP ticket, but he lost to INC candidate Laxman Sawad by 76,122 votes.

In 2021, Mahesh Kumarathali courted controversy after a video of him giving an extraordinary speech to flood-affected people went viral on social media. In one of the video clips, Kumatali was seen asking a person in the Athani taluk of the flood-affected district to also give him a ‘quarter’. In another video, shot at a guest house, Kumatal is seen expressing her “difficult situation”. He told his followers that he was busy with too many issues and that he wanted to throw away his mobile phone and sleep peacefully as he was fed up with calls from people affected by the floods. Consequently, Kumatali received widespread criticism, after which he apologized for his remarks. He said he had just recovered from COVID-19 at the time and didn’t want to hurt anyone.

Facts/Trivia
- In 2019, Pramod Hireman, who is the president of the Youth Congress in Athan, filed a habeas corpus petition in the Karnataka High Court, alleging that Mahesh Kumatal, MLA from Athan, was missing and possibly under illegal detention. MLA Ramesh Jarkiholi was accused of illegally restricting Kumathal. Accordingly, the High Court issued notices to the State Government and Jarkihall. Hiremani had earlier lodged a complaint with the police in Athan, but was told that Kumatal should be in Bengaluru where the assembly was in session. Hireman was looking for an MLA in Bengaluru and couldn’t find him; So he filed a petition. It was said that Mahesh allegedly informed the petitioner about the motion that Ramesh would force him to resign as MLA. At the time, Kumatal was one of the Congress members who stayed away from the assembly sessions and was believed to be in touch to switch allegiance to the BJP. It was alleged that the MLAs were in Mumbai at the behest of the BJP, which is trying to lure them to destabilize the coalition government in Karnataka.
- Although Kumatali successfully ousted the coalition government in 2019, her home village of Telasang and other villages in Athani taluk installed large hoardings on their outskirts to bar her entry. He was no longer welcome in the region to campaign because villagers accused him of selling his position for money. They claimed that the Kumatali chose to stay in Mumbai while their villages were flooded in the monsoon. Meanwhile, Chief Minister Siddaramaiah, who was campaigning in Telasang village ahead of the 2019 by-polls, accused Kumathal of “selling her” on the BJP’s money “like a sheep, a chicken or a buffalo”.
