Confrontation

On 27 June 2023, he was arrested by the Enforcement Directorate (ED) in connection with a money laundering case from his office in Delhi. The arrest followed a summons by the ED three days earlier. Many First Information Reports (FIRs) have been registered against the company and its directors in Uttar Pradesh, Delhi and Haryana. Allegations in these FIRs have accused the company of collecting money from homebuyers but not delivering the promised flats. As a result of the investigation, it was found that Supertechs Group was taking funds from home buyers and loans from banks for the construction of apartments. However, it is alleged that these funds were misused to purchase land. The purchased land was then used as collateral to cover bank loans. The ED investigation found that the Supertech Group defaulted on payments to banks and financial institutions resulting in loans of Rs. 1,500 crores will turn into non-performing assets (NPAs). Further, on April 12, 2023, the ED seized property worth Rs. 40 crore, including 25 plots of land and buildings in Uttarakhand, as well as Meerut Mall in Meerut, Uttar Pradesh, owned by Supertech and its directors. While appearing before the court on June 28, 2023, the ED said that it had transferred Rs. 638 crores collected from home buyers and received through bank loans. Instead of using these funds to complete the ongoing projects in Noida, it is said that the money was used to buy properties in Gurugram at inflated prices. In addition, he allegedly spent 100 GEL. 154 crore for procurement of ASP Sarin and Rs. 39 crore to acquire Palash Building Solutions. ED further stated that Rs. 444 crores in 2013-14 was used to purchase a company called Sarv Realtors Private Limited. The ED sought Arora’s 14-day judicial remand for further investigation into the allegations.

Facts/Trivia

  • In his free time, he enjoys watching the news.
  • In March 2022, his company faced financial insolvency and was formally declared insolvent by the National Company Law Tribunal (NCLT). The company had accumulated a debt of about 100 GEL. 432 million.
  • In August 2022, it suffered a major setback when the twin towers located in the ‘Supertech Emerald Court’ housing society in Sector 93A, Noida were demolished. In an interview, he talked about it and said:

UP Apartment Act, 1975 and UP Apartment Act, 2010, the developer goes to the authority to get approval. In terms of breaking the law, we have not broken any of them. When these plans were accepted, the flats act was not passed by the Noida authorities. And it wasn’t just for our project, it was for all approvals in the area. Between 2010 and 2014, no one got approval for the apartment deed. There was no special favor for us. What everyone was getting, we got the same.”
