In 2007, Daya Shankar Singh contested the Uttar Pradesh Legislative Assembly elections from Ballia constituency on a Bharatiya Janata Party ticket, but he lost. He again contested the Uttar Pradesh Legislative Assembly elections from Ballia Nagar constituency on a Bharatiya Janata Party ticket in March 2022. He defeated Narad Rai of the Samajwadi Party by 26,239 votes and became a member of the Uttar Pradesh Legislative Assembly. He was appointed as the Minister of Transport and took office on March 25, 2022.

On 20 July 2016, Daya Shankar Singh made a controversial statement against BSP national president and former chief minister Mayawati, saying that she is worse than a prostitute as she is selling party tickets to candidates for the 2017 assembly elections. He was suspended by the BJP for six years as the state vice-president of Uttar Pradesh and expelled from the party. Later, an FIR was lodged against him for making derogatory remarks against Mayawati. Soon after the FIR, he fled to avoid being caught; However, he was arrested in Buxar district of Bihar on 29 July 2016. He was in judicial custody in Maui, Uttar Pradesh. In August 2016, his wife Swati Singh filed a complaint against the BSP leader for threatening her 12-year-old daughter and mother-in-law under sections 120B (punishment for criminal conspiracy), 153 A (promoting enmity between different groups), 504 (intentional punishment) and criminal insult. 509 (Word, gesture or action to offend the modesty of a woman). On 6 August 2016, Daya Shankar got bail in the defamation case in Mau. In March 2017, Swati Singh won the assembly elections in Uttar Pradesh and the suspension of her husband, Daya Shankar, was lifted. He rejoined the BJP as its state vice president in Uttar Pradesh.
