Jyoti Singh was a 23-year-old girl who was a victim of the rape case on December 16, 2012 in Delhi. She passed away on December 29, 2012 due to multiple organ failure. Nirbhaya was her name given to her by the media, which means she is fearless.

Nirbhaya was born as Jyoti Singh in 1989 (23 years old at the time of her death) in the Ballia district of Uttar Pradesh. His family moved to Delhi after his father got a job at the Palam airport in Delhi. He did his studies in a public school in Delhi and after passing his 12th standard, he started preparing for the PMT (Pre Medical Examination). Having failed the PMT, Nirbhaya decided to further her education in physiotherapy and enrolled in a physiotherapy institute in Dehradun. After completing his course, Nirbhaya returned to Delhi in the year 2012 and joined an internship program at a physiotherapy hospital in Gurgaon (now Gurugram).

Family

Nirbhaya belonged to the Bhumihar community of a Hindu family. She was the daughter of Badrinath Singh and Asha Devi. She had two brothers.

On the night of December 16, 2012, Nirbhaya was returning home with her boyfriend, Awindra Pratap Pandey, after watching the movie “Life of Pi” in Saket, South Delhi. They were looking for an auto-rickshaw to reach their home in Dwarka when they boarded a decommissioned white private bus at around 9:30 p.m. When the couple entered the bus, they found there were only six male occupants inside, including the driver. They soon became suspicious as the bus veered off its route and the bus doors slammed shut.

When Nirbhaya’s boyfriend objected, the male riders taunted the couple, asking the reason why they were riding so late. After which, a fight broke out between her boyfriend and the male riders in which her boyfriend was struck unconscious with an iron bar. The passengers then dragged Jyoti to the back seat of the bus and brutally raped her one by one. As she tried to fend off her, one of the attackers inserted a rusty rod into her private parts, ripping open her intestines. After about an hour, Jyoti and her boyfriend were thrown from the moving bus in Mahipalpur. A passerby found them half dead on the road and informed the Delhi police. They were rushed to Safdarjung Hospital in Delhi, where doctors found the woman with only 5 percent of her intestines inside her body.

After her initial treatment at Safdarjung Hospital, she was taken to Mount Elizabeth Hospital in Singapore, where she succumbed to her injuries on December 29, 2012. Her postmortem reports revealed that her intestines, genitalia, and abdomen sustained serious injuries due to the assault.

Protesters clashed with police and were fired at by tear gas and water cannons. The incident was criticized by many countries in South Asia and the Middle East.

On December 29, 2012, the US Embassy issued a statement expressing its condolences to Nirbhaya’s family. Ban-Ki-Moon, the then UN Secretary General said:

Violence against women must never be accepted, never excused, never tolerated. Every girl and woman has the right to be respected, valued and protected”.

A Delhi Police team led by IPS officer Chaya Sharma was appointed to investigate the case.

Initially, the team faced several difficulties in tracking the bus as there were more than 1,600 white-colored private buses circulating on the roads of Delhi. However, the clue that the bus had yellow curtains and red seats helped them shortlist 300 buses of which they zeroed out the target bus within 18 hours of the incident.

The team then underwent an intensive search operation and managed to arrest all 6 defendants within 24 hours of the incident. The defendants were identified as Ram Singh, the bus driver, Mukesh Singh, Ram Singh’s brother, Vinay Sharma, an assistant gym instructor, Pawan Gupta, a fruit vendor and a 17-year-old boy from Badaun in Uttar Pradesh.

During the defendants’ trials, Ram Singh committed suicide in court custody while the minor was sent to the Correctional Facility.

IPS officer Chaya Sharma revealed in an interview that it was possible to catch the convicts only because of Nirbhaya’s statements. According to Chaya, his attitude was very positive and he wanted the culprits to be harshly punished for what they did to him. In December 2013, her family established the “Nirbhaya Trust” with the aim of providing shelter and legal assistance to women who have experienced violence. In the same year, she was posthumously awarded the “International Woman of Courage Award” by the United States Department of State.

On 13 March 2014, the 4 convicted men were sentenced to death by the Delhi High Court and the sentence was upheld by the Supreme Court.

On January 7, 2020, the Patiala House Court of Delhi issued a death warrant to hang the four defendants (Pawan Gupta, Mukesh Singh, Vinay Sharma and Akshay Singh) at 7 am on January 22, 2020. According to the sources, moments before the court order, the mother of one of them had approached Nirbhaya’s mother and pleaded for the life of her son. To this, Nirbhaya’s mother replied:

I also had a daughter. What happened to her, how can I forget? I have been waiting for justice for seven years…”

After using all possible judicial remedies, the defendants, Pawan, Mukesh, Vinay and Akshay were finally hanged in Tihar jail on the morning of March 20, 2020. According to the sources, the convicts did not express any “last wishes”.

In 2015, on the third anniversary of Nirbhaya’s death, her mother revealed her real name (i.e. Jyoti Singh) to the public at the Jantar Mantar in New Delhi (although Indian law does not allow the rape victim’s name to be revealed in public).

Leslee Udwin later directed and produced a documentary film, “India’s Daughter”, based on the Nirbhaya story, which was part of the BBC series Storyville. However, the film was later banned in India as Indian law does not allow the same.

In 2019, Netflix launched a web series titled “Delhi Crime” which gave the public a view of the case from the other side of the table.
