Jiah Khan’s Suicide Case

Jiah Khan committed suicide on 3 June 2013 by hanging from the ceiling fan of her bedroom at her residence Sagar Sangeet Apartment in Juhu, Mumbai. On 7 June 2013, the Mumbai police found a suicide note at Jiah’s residence in which Jiah mentioned the abortion of a child allegedly fathered by Sooraj Pancholi, son of veteran actor Aditya Pancholi. She also expressed her disappointment for not getting the love she expected and deserved from Sooraj. The letter also described the emotional and physical abuse Jiha endured during her relationship with Sooraj.

Rabia Khan Claims and Legal Proceedings

Based on the suicide note, Sooraj Pancholi was arrested on 10 June 2013 under Section 306 of the Indian Penal Code (IPC) for aiding suicide; However, the Mumbai High Court granted him bail on July 1, 2013, saying that he cannot be held solely responsible for the incident.

Rabia claimed that Jiah’s death was a murder and blamed Sooraj Pancholi for it. He also alleged financial improprieties involving money and jewellery. In an interview, she said that Jiah had given Sooraj Pancholi a substantial amount of money to buy jewelery for her sister’s 21st birthday; However, Sooraj failed to deliver the jewelery and did not inform Jia about the money. Despite apologizing and sending flowers, which Jiah throws away, she confronts Sooraj about the money. Jiah never revealed the outcome of this confrontation. Rabia also revealed that Jiah had shared the biometric lock of her apartment with Sooraj, making her suspicious of Jiah’s death. Sooraj, on the other hand, claimed that Jia was struggling with depression and he repeatedly tried to help her overcome it. He also stated that he informed Rabia about the situation, but she did not take any action, resulting in Jiah’s suicide. On 1 October 2013, Rabia approached the Bombay High Court alleging that her daughter Jiah Khan had been murdered and demanding a Central Bureau of Investigation (CBI) probe into the case. On 2 July 2014, the case was handed over to the CBI, which subsequently filed a chargesheet against Sooraj Fancholi. In 2016, the CBI ruled out any foul play and informed the high court that Jiah Khan’s death was a suicide. Rabia then hired a British forensic expert named Jason Payne James, who claimed that Jia’s death was “staged”. Rabia later filed a complaint in the Bombay High Court requesting a Special Investigation Team (SIT) to take up the case; However, the Bombay High Court dismissed his appeal in February 2017.

In September 2017, Rabia Khan wrote a letter to Prime Minister Narendra Modi seeking justice. He then approached a special CBI court in Mumbai and filed a complaint for further investigation into the case, which was later dismissed. In 2021, Jiah’s case was transferred to a special CBI court after a sessions court said it lacked jurisdiction following a CBI investigation. In 2022, the Bombay High Court dismissed Rabia’s petition seeking a fresh investigation into the case. On 28 April 2023, a special CBI court in Mumbai acquitted Sooraj Pancholi in the Jiah Khan suicide case due to lack of evidence. In its verdict, the court said that the evidence against Sooraj Pancholi was “vague and general” and that Jia was a “victim of her own feelings”. Special CBI court judge AS Sayyad noted that Jiah had suicidal tendencies that only Sooraj Pancholi knew about. The judge also said that Sooraj could not devote her time to Jiah as she was focused on her acting career and Rabia tried to prove that Jiah did not commit suicide but was murdered, contradicting the prosecution’s case and ultimately undermined her. Sayyid in his jurisdiction said:

In this case, it cannot be ignored that the deceased had suicidal tendencies. He tried to commit suicide earlier and at that time the accused called a doctor. The accused treated her and tried to bring her out of depression. At the relevant time, the accused continued his acting career and could not devote enough time to the deceased. However, on the earlier occasion when she tried to commit suicide, the accused saved her and helped her to get out of depression. Rabia tried to show with her evidence that Jiah never killed himself and it was the accused (Pancholi) who killed him. However, this is not the case of the prosecutor’s office. When the prosecution’s case was about suicide, Rabia claimed that it was murder. By giving such openly contradictory evidence, the appellant has himself destroyed the prosecution’s case.”

After the court’s verdict in the Jiah Khan murder case, Rabia Khan said that Sooraj Pancholi is not guilty of aiding suicide, but aiding and abetting murder. Reacting to the verdict in an interview, Rabia decided to appeal the decision to the Supreme Court. She said,

The charge of suicide was dropped. But how did my son die? This is a case of murder… going to the High Court. The verdict is presumed suicide, but I have always maintained that Jiah was murdered. It actually strengthens my case.”
