As news of the MP’s arrest spread, the video quickly gained popularity on social media. However, Citizen Digital has acknowledged that it is an old video that was filmed on September 27, 2017.
The incident occurred at the Milimani Law Courts, where Babu Owino was charged with subversion, offensive behavior and a separate charge of incitement to violence.
Shortly after a Nairobi magistrate’s court released Babu Owino on the aforementioned date, the police detained him again.

Babu was then re-arrested, according to police, in connection with an assault offense he committed earlier while running for president of the Nairobi University Students’ Organization (SONU).
However, on Wednesday morning, the MP announced on his Facebook page that he had been arrested.
“After I arrived from Mombasa, the DCI JKIA arrested me. Currently in custody,” she wrote. Citizen Digital subsequently contacted the MP for comment, however a call to his phone was unsuccessful.
The alleged arrest is related to the upcoming anti-government demonstrations authorized by the Azimio la Umoja alliance.

Owino was charged in September 2021 with intimidating journalists and making threatening phone calls and text messages.
According to various Kenyan media outlets, Owino was arrested in September 2017 for insulting Kenyan President Uhuru Muigai Kenyatta.
Many political heavyweights in Kenya demanded that he face serious legal repercussions for violating his right to free speech by making openly derogatory statements about the president.
In Nairobi, he was arrested and charged with inciting hatred. Owino has often been accused of attacking various people in Kenya, including fellow lawmakers, parking attendants, night guards, and many more.
