Controversies

Misuse of political power as an advocate

In January 2022, 157 lawyers of the Calcutta High Court collectively wrote a letter to Chief Justice of India N.V. Ramana, Chief Justice of West Bengal HC Prakash Shrivastava, and West Bengal Chief Minister Mamata Banerjee in which they alleged Kalyan Banerjee of insulting women lawyers, giving undue privilege to some in exchange for unexplainable favours, and misusing his political power. The lawyers also accused him of disregarding the state’s highest constitutional authority, the governor, by making derogatory public remarks about him which is inappropriate for a senior Bar member.

Police complaint for mimicry of Jagdeep Dhankhar

On 19 December 2023, Kalyan Banerjee was accused of mocking Vice President Jagdeep Dhankhar on the premises of the Parliament complex during the opposition’s protest against the suspension of MPs. Kalyan allegedly made fun of Dhankar for the way he walked by leaning forward and Rahul Gandhi was seen filming the video. Later, advocate Abhishek Gautam filed a complaint at the Defence Colony Police Station in which he accused Kalyan of insulting and defaming the Vice-President of India, his caste, and his background as a farmer and demanded registration of an FIR under the appropriate sections of IPC and the IT Act against the TMC MP. Dhankar later expressed his anger in the parliament and said,

As an individual, take on me, don’t take on my background as a farmer, don’t take on my background as a community member. Institution of Chairman has been ravaged and that too by a political party that has gone so far that a Member of Parliament, a senior one, videographs the other member.”

In an interview, Kalyan while talking about the incident said,

I am a member of the Lok Sabha. I have never seen Rajya Sabha proceedings or Rajya Sabha TV. How will I be able to copy Dhankharji? I am surprised he took it personally. Does he behave like this only? This is an art and he should take it sportingly.”
